Please read these terms and conditions carefully before placing your order on our website at https://winestore.aberdeenmarinaclub.com/ or the mobile application (collectively referred to as "AMC Wine Store"). The use of our website and all orders placed on AMC Wine Store are subject to these terms and conditions, and our AMC Wine Store Privacy Policy (together, the “Terms and Conditions”).
We may amend these Terms and Conditions at any time without prior notice. Amendments will be posted on our website. Your continued use or placement of orders on AMC Wine Store after any such amendment constitutes acceptance of the amended Terms and Conditions. If you do not agree to these Terms and Conditions or any revised version of the Terms and Conditions, please do not use or place any orders on AMC Wine Store.
1.0 General
1.1 In these terms and conditions, “the Club” or “we” or “us” refers to the Aberdeen Marina Club and “Member” or “you” means any person who places an order with us.
1.2 Under Hong Kong law, it is illegal to sell alcohol to persons under the age of 18. By placing an order, you confirm that you are 18 years old or above. You must ensure that no other person except yourself shall use your login to purchase alcohol products. A person aged 18 years or above must take delivery of the products, otherwise the delivery shall be withdrawn and rearranged at your expense. For compliance with applicable law and regulations, we and our service provider(s) may request for proof of identification to verify that you are above 18 years of age. We may cancel your order, refuse collection by you or refuse delivery of the product(s) to you if you are unable or unwilling to provide proof of identification.
1.3 You confirm that the product(s) ordered by you are for private consumption only. If we have grounds to believe that you are not purchasing the product(s) as an end-user, we reserve the right to decline or cancel your order.
2.0 Product Description & Prices
2.2 Prices for wines are quoted on a per bottle basis, unless otherwise stated. Case discount (if available) is quoted on the basis of an unmixed case of 12 bottles (as the case may be).
2.3 Prices and availability are subject to change without prior notice. We will endeavour to keep the information, pricing and availability of stock current, but we are not liable for any error or failure to update information, pricing or availability.
2.4 Wine ratings are provided for information only and may not represent the most up to date evaluation. You should not rely on the ratings for making purchase decisions and should make your own enquiries as appropriate. We are not liable for any error or failure to update wine ratings.
2.5 No further discount applies to promotional or case discount items, unless otherwise stated.
2.6 Product images are for reference only. Please refer to the actual product description when making a purchase.
3.0 Contract
3.1 Any order placed by you for any product or service on AMC Wine Store is an offer by you to purchase such product or service from us.
3.2 Fulfillment of your order is subject to availability (see section on Availability below). We may accept or reject any order (or part thereof) at our sole discretion.
3.3 There is no contract between you and us unless and until we have accepted your order by the issue of an order confirmation. These terms and conditions shall govern and be incorporated into every contract between you and us for purchases made on AMC Wine Store.
4.0 Availability
4.1 All products and services are subject to stock availability. Our ability to supply or fulfill your order is limited by the quantity and bottle sizes of products finally supplied to us by our suppliers. We reserve the right at our discretion to allocate stocks amongst Members in such proportions as we deem fit. Some Members may not be allocated any or may be allocated only some of the quantities that they have ordered.
4.2 If at any time, whether before or after an order has been accepted, products or services are out of stock and/or unavailable for any reason whatsoever, we reserve the right to (a) reject your order; or (b) terminate all or any part of your order, provided that if we reject your order, you will not be charged for such order and if we terminate your order (or a part thereof), we will rebate the amount of products and services charged with respect to such cancelled order (or part thereof) to your Member’s account within 8 weeks of cancellation, without any interest and net of all bank charges and fees.
4.3 We are not and will not be liable to you for any loss, damage, claims, costs and expenses whatsoever and howsoever arising in connection with the rejection or termination of any order (or a part thereof).
5.0 Breakages, Shortages, Packaging Issues or Wrong Order
5.1 Please inspect the products (including wines) upon delivery and notify our customer hotline +852 2814-5391 immediately of any breakages, shortages or wrong order. We reserve the right to refuse any claim made after such time.
5.2 If you are not present to accept delivery, you may request us to deliver your order to your authorized representative by contacting our customer hotline +852 2814-5391. However, please note that acceptance of delivery by an authorised representative is entirely at your own risk and neither we nor our delivery company will be responsible for any breakages, shortages or wrong order or for any loss or damage to the products arising as a result of delivery to your authorised representative.
6.0 Return, Refund or Replacement Policy
6.1 Wines are a perishable product and some wines may deteriorate over time or if not stored under correct conditions. Whilst we take reasonable care when sourcing wines, our suppliers are responsible for exercising quality control over the wines and we do not independently test, examine or inspect individual wines. Accordingly, please note that we do not accept liability for wines (which include any wine, alcohol or spirit) over HK$700 per bottle and/or more than 10 years old and/or any promotional and discounted item.
6.2 If a bottle of wine is corked or defective, please contact our customer hotline +852 2814-5391 immediately on becoming aware of the defect. Otherwise, under normal circumstances, we would not accept any request for exchange of products or cancellation of orders. We may at our absolute option, provide a refund or replace the defective wine, provided that the following conditions are satisfied:
· the defect is caused by us or by the supplier or producer and if by the latter, we successfully claim the same against the supplier and/or the producer;
· the bottle was purchased from us within 48 hours;
· you notify us within 1 day (24 hours) after such bottle is opened, and return the bottle to us with at least two-thirds of the wine left inside so we can verify its quality;
· you provide to us with a valid original receipt for the bottle of wine; and
· such wine must be below HK$700 per bottle, be less than 10 years old and be non-promotional and non-discounted item.
6.3 If you require us to collect the product, a charge of HK$200 will be payable. This charge is refunded if the wine is found to be defective and a refund or replacement is offered in accordance with Clause
6.4 We will inspect any alleged defective product in good faith but our decision will be final. If products are found to be defective, we may, at our absolute option, provide a refund or replace the defective products. Refunds (if any) will be credited to your membership account within 8 weeks upon confirmation, without interest.
6.5 No returns are allowed for glassware or accessories after the you or your authorised representative has acknowledged receipt of the Goods.
7.0 Risks and Title
7.1 All risks of and title to, the products ordered shall pass to you upon delivery, except that if full and final payment has not been received by us for any reason whatsoever, the title to such products shall remain with us until receipt of full and final payment.
8.0 Wine Event Tickets
8.1 In the event of cancellation of a wine event by a third-party organiser or sponsor of such wine event, we will, after receipt of refunds from such organiser or sponsor, refund the amount in full (or if only partial refunds have been received by us, a pro rata portion thereof), to you as soon as possible, without any interest.
9.0 Payment Terms
9.1 All prices listed are in Hong Kong dollars.
9.2 All transaction payment will be billed to your Member’s account only, no other means of payment is allowed.
9.3 We will issue an invoice detailing the charges applied to your Member's account after order confirmation.
9.4 Invoices will be sent electronically to the email address provided by you during registration.
10.0 Delivery
10.1 We deliver to all home or office addresses on Hong Kong Island, in Kowloon and in the New Territories.
· For the time being, we are unable to deliver to Peng Chau, Cheung Chau and Lamma Island.
· Delivery schedule from 10am to 7pm.
· Delivery service to Hong Kong Island: Monday and Friday: For orders under HK$2,000, a delivery charge of HK$150 per delivery address will apply. Orders over HK$2,000 per delivery address are delivered free of charge.
· Delivery service to Kowloon: Wednesday: For orders under HK$2,000, a delivery charge of HK$200 per delivery address will apply. Orders over HK$2,000 per delivery address are delivered free of charge.
· Delivery service to New Territories, the Hong Kong International Airport area, including Tung Chung, Discovery Bay and Ma Wan: Wednesday: For orders under HK$2,000, a delivery charge of HK$250 per delivery address will apply. Orders over HK$2,000 per delivery address are delivered free of charge.
Ma Wan deliveries are only available between 10:00am and 4:00pm on weekdays, due to restricted access after 4:00pm.
Specified dates: an additional surcharge of HK$200 per delivery address will apply for deliveries on specified dates, regardless of the order amount. Please contact us in advance to confirm the arrangement.
10.2 Delivery is free for orders of HK$2,000 or more, per delivery address (excluding specified dates).
10.3 You may collect your orders in-store within 3 months from the date of purchase, during regular business hours, regardless of the order amount. A maximum of 12 bottles may be collected per order under this policy.
10.4 Cut-off time is 3pm.
· For orders successfully placed at our Website before 3pm between Monday and Sunday (excluding Wednesday) and confirmed by us via email, delivery to your specified address will be on the following delivery day.
· For orders placed after 3pm on Tuesday or Wednesday, delivery date will be the following delivery day after Thursday.
· We will deliver as scheduled to the best of our ability. Delivery may be affected due to seasonal factors (e.g. special promotional events) and festive periods (e.g. Christmas or Chinese New Year) as we may need to cope with high volume of orders.
10.5 Delivery will be arranged any time within the scheduled time slot.
10.6 We reserve the right to charge for re-delivery of orders which could not be completed due to incorrect address information provided by you or the recipient not being available to accept delivery at the scheduled time slot.
10.7 Delivery service will be suspended when typhoon signal No.8 or above or a black rain warning is hoisted. In such event, you will be contacted to re-schedule delivery time.
10.8 We reserve the right to decline delivery of goods to any Member or recipient at our sole discretion.
10.9 Our delivery service is available to addresses accessible by elevator only. If the address is not accessible by elevator, the goods must be received on G/F or the delivery will be cancelled with an administration fee of HKD200. 11.0 Non-pickup/ non-delivery
11.1 We may levy storage charges for purchased items which have been made available for collection but have not been collected, or which are ready for delivery but cannot be delivered, in either case, within 90 days of purchase for any reason, including without limitation your failure to pick up such products, failure to notify us of any change of address, or refusal to take the delivery.
11.2 If the purchased products have not been collected or delivered and the storage fees referred to above have not been paid for three (3) months from notification by us, then we have the right to deal with or otherwise dispose of such products (including resale of any of the items) at our absolute discretion, without any further notice to you and without having to account to you any proceeds (if any) arising therefrom. We shall have no liability to you in respect of dealing or disposal of such items in such circumstances.
12.0 Third Party Checks
12.1 If you purchase products and/or services from us, we may, but are not obligated to, contact third party organisations to verify the information you have provided to us and to ensure our records are up to date. Such verification may consist of checking your name and address, payment instructions or conducting credit and other checks. Such checks are undertaken to help and protect you and as a means to counter fraudulent activities. They also help to ensure that our mailings and correspondence are being sent to the correct people at the correct addresses. These checks are not infallible and therefore please advise us as soon as possible if any of your details change.
12.2 All information obtained through such checks shall be used by us in accordance with our Privacy Policy (please see section on Privacy Policy below).
13.0 Other Services and Promotions
13.1 We may offer other services and promotions not specifically referred to in these terms and conditions. Such services and promotions may be subject to additional terms and conditions which will be made available on the relevant page at the time the services and promotions are offered. By ordering such service or promotions, you will be bound by such additional terms and conditions.
14.0 Force Majeure
14.1 We shall not be liable for any failure to meet our obligations occasioned by circumstances beyond our reasonable control. We will give you notice of any such circumstances as soon as is reasonably practicable.
15.0 Privacy Policy
15.1 You will be required to provide certain personal data in order to register on AMC Wine Store and make purchases on AMC Wine Store. We collect, use, disclose, process and hold data relating directly or indirectly to any customer, website user and any other relevant person in accordance with the provisions of the Personal Data (Privacy) Ordinance and our privacy policy, a copy of which is available here. Please read our privacy policy carefully as it contains important information about the data we collect, the purposes for which the data is used and your rights to obtain access to the data collected about you.
16.0 Miscellaneous
16.1 We retain our right to exercise or enforce any right contained in these terms and conditions. If we fail to, or choose not to, take any action, it shall not be deemed to be a waiver of our right to take such action or any subsequent action in respect of that right or any other rights.
16.2 If any provision of these terms and conditions is found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, the invalidity or unenforceability of such provision shall not affect the other provisions of these terms and conditions. All provisions not affected by such invalidity or unenforceability shall remain in full force and effect.
17.0 Limitation of liability
17.1 Except for death or personal injury caused by our negligence, we accept no liability and shall not be responsible for any indirect, consequential, special, economic or exemplary losses or damages howsoever they may arise, whether foreseeable or otherwise.
18.0 Law and Jurisdiction
18.1 These terms and conditions are governed by and shall be construed in accordance with the laws of Hong Kong Special Administrative Region (“Hong Kong”). You agree to submit to the non-exclusive jurisdiction of the Hong Kong courts.
18.2 These terms and conditions are written in the English language and may be translated into Chinese. In the event of any inconsistency between the English version and the Chinese version, the English version shall prevail.
